One of the first questions home buyers ask is: how much will the lawyer cost? Here is an honest breakdown of what makes up the total, based on how fees actually work in Ontario.

Legal Fees Vary

The Law Society of Ontario does not set fees for legal services, and there is no official published fee schedule for real estate lawyers in Ontario. Fees vary from firm to firm and depend on the complexity of your file. A straightforward purchase with a clean title costs less than a file involving a private sale, power of attorney signing, title problems, or a rush closing. Always ask for a written quote before you commit.

Disbursements

On top of the legal fee, you pay disbursements. These are third-party costs your lawyer pays on your behalf and passes through to you: title search fees, registration fees, and courier charges, among others. Ask that any quote itemizes disbursements separately so you can compare quotes fairly.

Land Transfer Tax

This is separate from legal fees but often confused with them. Ontario charges land transfer tax on every purchase at graduated marginal rates: 0.5% on the first $55,000, 1.0% up to $250,000, 1.5% up to $400,000, and 2.0% up to $2,000,000 (2.5% above that for properties with one or two single-family residences). Toronto buyers also pay the City of Toronto’s municipal land transfer tax on top. Qualifying first-time buyers can receive a provincial refund of up to $4,000.

Title Insurance

Title insurance is not legally required in Ontario, but it is strongly recommended and often required by mortgage lenders. It is a one-time premium that protects against title fraud, survey issues, and other hidden defects that a title search cannot catch.

What Affects the Price

Complex files cost more: private sales, power of attorney signings, title problems, or rush closings. When comparing quotes, ask what is included. A low headline fee with high disbursements is not a deal.
